PERMIT #: M-1982-015
INSPECTOR'S INITIALS: PSH
INSPECTION DATE: December 10, 2015
required fee for the technical revision. The technical revision was not processed by the Division due to the
lack of the required fee and the problem cited with the Operator's name. The lack of the required fee and the
Operator name was discussed with Mr. Kyle Schildt with LTE at the time of the submittal. The Division will
follow up under separate cover regarding the technical revision request.
The approved post -mining land use for the site is developed water resource. Mining activities are complete
and the site is in final reclamation. The slurry was approved by the Division of Water Resources on September
7, 2007. The slurry wall was breached during the 2013 flood event. The Operator will need to submit
confirmation from the Division of Water Resources of the approved repaired slurry wall prior to Division
consideration of a final release request.
The lakes were dewatered during the inspection. Residential development is underway to the north of the
site. Spillways have been constructed in the southwest corner of the site, between the eastern and western
lakes and east end of the site as part of the 2013 flood repair work. The Operator will be required to update
the approved reclamation plan for the site by submitting a technical revision to indicate the spillways and
provide the spillway engineering designs.
Evidence of recent regrading work was observed during the inspection. It appears the grading was done in
compliance with TR -05 to create wetland benches. The site vegetation consisted of well-established native
grasses, bare ground and areas of annual weeds. The site appeared stable and no erosion features were
noted.
The water samples from the filled lakes to determine if the fuel spill impacted the water quality as required by
TR -03 have not been submitted by the Operator. The Operator must comply with this requirement of TR -03
prior to Division consideration of a final release request.
The Division holds a financial warranty in the amount of $115,545.00, which is sufficient to complete
reclamation at the site. The required mine sign and boundary markers were not observed during the
inspection.
