Exhibit D — Mining Plan <br />1. The method of mining will be to utilize a loader, truck and/or dozer for digging. Material will be <br />stockpiled for use in final sloping and reclamation. No processing of material is anticipated. <br />The pit is accessed from County Road 31. <br />2. No water has been used or is anticipated in conjunction with the operation. Mining will not be <br />close to any groundwater. There could be instances when heavy rainfall makes the site too <br />muddy to work. At those times, efforts to re -slope will simply cease until the site becomes dry <br />enough to work again. With a 4 foot berm in the Northwest Corner, no waste runoff should <br />occur. <br />3. The size of the area to be worked at during any one time is less than 3 acres. <br />4. The maximum gradient of reclaimed slopes will be 3:1. <br />5. Mining was originally 25-30 feet in depth. Mining depth was not close to existing groundwater. <br />No final slopes will be greater than 3:1. <br />6. The nature of the stratum immediately beneath the material to be mined is gravel and dirt. <br />7. The primary and secondary commodities to be mined are sand and gravel. The intended use for <br />the commodities is for various road maintenance and repair on county gravel roads. <br />8. No refuse, acid, or toxic producing materials are anticipated at the site. Other mining <br />enterprises in this part of Kit Carson County have never yielded any such materials. <br />9. Reclamation will be implemented at the conclusion of mining activities. The operator will <br />follow guidelines in establishing that the area be returned to pastureland use. <br />10. Guidelines for reclamation will be followed according to the recommendation of the NRCS <br />office. <br />11. The finished pit will be seeded to provide for pastureland. There should be no disturbance to <br />the hydrologic balance. <br />12. No explosives will be used in this operation. <br />
