M-1982-098; 110c to 112c Conversion Application Adequacy Responses <br />Dear Mr. Russell: <br />In response to your letter dated November 20, 2015 we have made the necessary changes to the <br />adequacy letter and our responses are: <br />1. Submitted proof of publication in a newspaper of general circulation in the locality of the <br />proposed mining operation. <br />See attached papers -Proof of Publication <br />2. Submitted proof of notice to all owners of record of surface rights of the affected land and the <br />owners of record of all land surface with 200 of the boundary. <br />See attached papers -Public Notice and copies of certified mail receipts <br />3. Letters from the Division of Water Resources and Colorado Parks & Wildlife -responses <br />See attached letters stating that we addressed their concerns and will work with them fully if <br />anything is found to be a problem. <br />4. Performance Warranty - <br />See attached form -Signed, notarized, and dated October 28, 2015 <br />5. Exhibit C- updated the previously submitted map which portrays all adjoining surface owners of <br />record. <br />6. Exhibit C -Submitted a new map which legibly portrays the type of present vegetation covering <br />the affected lands. <br />7. Exhibit C -Submitted a new map which shows the location of all permanent or man-made <br />structures contained on the area of affected land and within 200 feet of the affected land; the <br />map also contain labels of structures which list the owners name and type of structure. New <br />map also depicts the power poles and County Road 31. The fence line was added inside the <br />permit boundary on the map. <br />8. Exhibit D- A 4 foot berm will be added in the North West corner so that waste runoff will not <br />occur. <br />See Mining Plan- <br />
