COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />December 22, 2015 <br />John Crowley <br />382 McArthur Dr. <br />Lone Tree, CO 80124 <br />RE: Notice of Intent to Conduct Prospecting Application; LGPD2-2; DRMS File No. P-2015- <br />021; Notice of Deficiencies <br />Dear Mr. Crowley, <br />On November 30, 2015, the Division of Reclamation, Mining and Safety (Division) received the <br />Notice of Intent (NOI) to Conduct Prospecting Application for LGPD2-2, File No. P-2015-021. <br />The Application was filed for review on November 30, 2015. Our review indicates the NOI <br />application contains deficiencies as defined by Rule 5.1.3 of the Mineral Rules and Regulations <br />of the Colorado Mined Land Reclamation Board for Hard Rock, Metal, and Designated Mining <br />Operations. The Division requires the information described below before we can approve the <br />NOI application. <br />1. The first page of the application form specifies that Mr. Michael Royer is the individual who <br />will be conducting prospecting activities. However, Section VIII: Signature Requirement of <br />the application (page 9) is initialed and signed by Mr. John Crowley. Please clarify if Mr. <br />Royer or Mr. Crowley is the Operator/holder of the NOI. If Mr. Crowley will be the <br />Operator, then the first page of the application form must be revised to reflect this. If Mr. <br />Royer will be the Operator, then no change to the application form is necessary. <br />2. The applicant has specified the LGPD2-2 prospecting site is located within the SW '/ of the <br />SW '/ of Section 17. However, the location information provided on the financial warranty <br />form states the site is located in the SE '/ of the SW ' of Section 17. Please confirm the <br />quarter/quarter section where the site is located and make the necessary revisions on either <br />page 2 of the application form or page 1 of the financial warranty form. <br />3. The application states 360 cubic yards of material will be moved during the course of <br />prospecting. In addition, the applicant is proposing to excavate 5 test pits which are 16' x 16' <br />x 6', or 284 cubic yards of material. Please clarify if 284 cubic yards or 360 cubic yards of <br />material will be moved.
