It seemed appropriate to have these comments on record to establish context for <br /> this Amendment submittal: <br /> On 13 August 2013, the Office wrote a letter indicating it denied our request for a <br /> Technical Revision intended to provide the specifications for lining our completed basins <br /> at our Western Sugar project. The stated reason is the need to change the post-mining <br /> land use by Amendment to Developed Water Resource. The Applicant never had <br /> opportunity to rebuttal the opinions of the Office, nor were the Application Fees <br /> refunded. Essentially, our opinion was never considered before the Office made its <br /> determination. <br /> This submittal attempts to remedy the matter by applying for Amendment, instead of <br /> persisting by way of Technical Revision, in regard to our good history and relations with <br /> the diverse members of the Office. Still, we think some aspects of the prior submittal, <br /> which form this Amendment, as a requirement of process asserted by the Office, needs <br /> to be set down for continuity and durability of any subsequent interactions. <br />
