Varra Companies, Inc.
OFFICE OF SPECIAL PROJECTS
8120 Gage Street Frederick,CO 80516 Telephone(303)666-6657 Fax(303)666-6743
etc.) for continued industrial - commercial use (as validated by
any co-related and required Weld County Building Permits); the
creation of unforeseen future structures, and for the use and
development of on-site water resources. Since the area of
surrounding lands is a mix of these uses, the site end use will
retain these potentials.
From Exhibit G:
The reclamation plan provides that the pits will be lined after
being mined. The lined pits will not require replacement water
and will be used for storage. There may be incidental demand for
water to establish vegetation on the site after lining is
completed. However, the ultimate demand for water will be
zero.
From Exhibit L:
NOTE: The basins resulting from extraction will be reclaimed in
an unlined state, since the operator retains sufficient water
resources to do so. The basins may be lined or otherwise
segregated from the area groundwater as an option to the
approved permit, in order to liberate the water otherwise
retained to supplement loss from evaporation in the unlined
state. Since sufficient water resources exist, the option to line
the resulting basins at an unspecified time during the life of the
permit is retained under this application and as part of the
approved permit.
Adequacy Review (as stated over several correspondence from December
2010 to March 2011)
Of special i iute is the Acequacy letter and reply of 23 February 2011. In
this correspondence, any misunderstanding as to custom is intended to
be repaired by an invitation by the Office to revise page four of the 112
Application Form to reflect the multiple post mining land uses stated
throughout the permit application exhibits. This revision was made
and included in the reply, and included 'Developed Water Resources,' as
shown in the included attachment of that correspondence, now on file with the
Office. Other references relevant to intent are made manifest in the several
adequacy correspondence extracted and otherwise made evident, as follows:
Varra Companies, Inc. Western Sugar Land Development Project 4
OMLR Permit #: M-2010-049 Amendment 7 December 2015
