noxious weed species (i.e., Tamarisk and Russian Olive trees) in the permitted area, <br />and failed to reduce the spread of weeds to nearby areas. <br />5. The February 7, 2013 inspection report required Operator to complete <br />the following corrective actions: (a) submit additional financial warranty, in the <br />amount of $15,900, by May 4, 2013; (b) demonstrate that reclamation had been <br />completed by December 31, 2013; and (c) either implement an approved weed <br />control plan or develop a weed control and management plan and submit it as a <br />Technical Revision by May 4, 2013. The deadline for implementing weed control <br />was subsequently extended to December 31, 2013. <br />6. Based on the Division's observations during the February 7, 2013 <br />inspection, the Division calculated the cost to reclaim the site at $25,400. The <br />Operator had $9,500 in financial warranty on deposit with the Division. The new <br />required financial warranty, $25,400, resulted in an outstanding financial warranty <br />amount of $15,900. The additional financial warranty was submitted on July 25, 2013. <br />7. A follow-up inspection was conducted on October 4, 2013 to determine <br />whether any progress had been made toward completing the corrective actions. No <br />evidence of progress was observed at that time. <br />8. On July 3, 2014, the Division again inspected the site. The Operator <br />did not attend the inspection. During the inspection, the Division observed that the <br />construction waste that was on the southwestern portion of the permit noted in <br />previous inspection reports, had been removed. The Division observed that "no <br />other reclamation worked had been done since the February 7, 2013 inspection." <br />Specifically, the Division found that banks of the pond had gradients of 1.5H:1V to <br />2.5H:1V and a large stockpile of material extended along the southern portion of the <br />permit area, estimated to contain approximately 13,500 cubic yards of topsoil and <br />overburden. The Division also observed numerous noxious weeds, including <br />Tamarisk and Russian Olive trees along the edge of the pond. The Division <br />observed that "it appears that no other reclamation work has been done since the <br />February 7, 2013 inspection." <br />9. The July 3, 2014 inspection report required the Operator to complete <br />the following corrective actions: (a) implement weed control at the site in accordance <br />with approved reclamation plan, including removal of Tamarisk and Russian Olive <br />trees from disturbed areas; (b) grade all pond slopes to 3H:1V or flatter; (c) remove <br />the overburden stockpile located in the southern portion of the permit area; and (d) <br />revegetate the ground beneath the stockpile. <br />Bent County Ready Mix <br />Thomeczek Pit, M-1995-007 <br />MV -2015-026 <br />2 <br />
