Jim Kiger
Page 2
November 13, 2015
Rule 2.05.6(6)(e)(iii) —The subsidence is predicted to cause no material damage or diminution
of reasonably foreseeable use, the Elk Creek Mine PAP includes a subsidence monitoring
program that is designed to determine the accuracy of the predictions made in the permit as
required by Section 2.05.6(6)(e)(i)(D).
The survey of the first area, near the Sanborn Creek Mine, did not identify any new subsidence
related features or any movement in the pre-existing features. Likewise, the survey of the
second area overlying the Elk Creek Mine did not reveal the development of any new features or
identify any movement of the pre-existing features, however minor tension cracks in sandstone
outcrops were still visible. The cracks are associated with the Longwall Panel #1. The Bear
Creek two -track ranch road did not have any additional tension cracks at the time of the survey.
Please feel free to contact me with any questions or comments.
Yours sincerely,
Leigh Simmons
Environmental Protection Specialist
