Jim Kiger <br />Page 2 <br />November 13, 2015 <br />Rule 2.05.6(6)(e)(iii) —The subsidence is predicted to cause no material damage or diminution <br />of reasonably foreseeable use, the Elk Creek Mine PAP includes a subsidence monitoring <br />program that is designed to determine the accuracy of the predictions made in the permit as <br />required by Section 2.05.6(6)(e)(i)(D). <br />The survey of the first area, near the Sanborn Creek Mine, did not identify any new subsidence <br />related features or any movement in the pre-existing features. Likewise, the survey of the <br />second area overlying the Elk Creek Mine did not reveal the development of any new features or <br />identify any movement of the pre-existing features, however minor tension cracks in sandstone <br />outcrops were still visible. The cracks are associated with the Longwall Panel #1.
