The Division received the report on October 14, 2015, and finds that it satisfies the requirements <br />of the rules and of the Elk Creek Mine Permit Application Packet (PAP). <br />In particular: <br />Rule 2.05.6(6)(a)(i) —The PAP includes an inventory of buildings and renewable resources which <br />exist within or adjacent to the permit area. It was determined that none of these buildings <br />would be effected by subsidence or landslides, and that no renewable resources exist within or <br />adjacent to the permit area, (confirmed by the USDA- Forest Service). <br />Rule 2.05.6(6)(c) —The program described in the PAP requires that two mining areas are <br />monitored: the area in the vicinity of the Sanborn Creek Mine, and the historic landslides in the <br />Bear Creek drainage located within the Elk Creek Mine permit boundary. <br />The focus of the monitoring near the Sanborn Creek Mine is on landslide and rockfall locations <br />in Coal Creek, the unnamed drainage between Sanborn Creek and Coal Creek, and Hawksnest <br />Creek. These areas must be visited twice a year, in June and in October. <br />The areas monitored in the Elk Creek Mine are frequently used roads located near historic <br />landslides in the Bear Creek drainage. These areas must also be visited in June and October. <br />If there is any significant movement in either of the monitoring areas, OMLLC must notify the <br />Division in a timely manner and submit a report on the movement.
