COLORADO <br />Division of Reclamation, <br />-AT, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Interoffice Memorandum <br />November 13, 2015 <br />From: Clayton Wein <br />To: Leigh Simmons <br />Subject: Elk Creek 2015 Annual Subsidence Report <br />The 2015 Annual Subsidence Report submitted by Oxbow Mining, LLC (OMLLC) on behalf of the Elk <br />Creek Mine is in compliance with the Division's Rules and the approved permit application (PAP). The <br />report was received on October 14, 2015. <br />The report is in compliance with the following Division Rules: <br />Rule 2.05.6(6)(a)(i)—The PAP includes an inventory of buildings and renewable resources which <br />exist within or adjacent to the permit area. It was determined that none of these buildings <br />would be effected by subsidence or landslides, and that no renewable resources exist within or <br />adjacent to the permit area (Confirmed by the USDA- Forest Service). Therefore, no further <br />information was provided for this section. <br />Rule 2.05.6(6)(c) — The monitoring program in the PAP consist of two mining areas; the area in <br />the vicinity of the Sanborn Creek Mine and the historic landslides in the Bear Creek drainage <br />located in the Elk Creek Mine permit boundary. The focus of the area near the Sanborn Creek <br />Mine is on landslide and rockfall locations in Coal Creek, the unnamed drainage between <br />Sanborn Creek and Coal Creek, and Hawksnest Creek. These areas will be visited twice a year, in <br />June and in October. The areas monitored in the Elk Creek Mine are frequently used roads <br />located near historic landslides in the Bear Creek drainage. These areas will also be visited in <br />June and October. If there is any significant movement in either of the monitoring areas, OMLLC <br />will notify the Division in a timely manner and submit a report on the movement. After the <br />monitoring is conducted in October, OMLLC will submit an annual written report to the Division. <br />2.05.6(6)(e)(i)(D) —The Elk Creek PAP includes a section to predict the effects of subsidence <br />within and adjacent to the permit area. <br />Rule 2.05.6(6)(e)(iii) —The subsidence is predicted to cause no material damage or diminution <br />of reasonably foreseeable use, the Elk Creek PAP includes a subsidence monitoring program that <br />is designed to determine the accuracy of the predictions made in the permit as required by <br />Section 2.05.6(6)(e)(i)(D). <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us <br />John W.
