hunters were making new trails on the BLM where there had been no roads or trails before this <br />year. LSFO and DRMS participated in a joint inspection of the alleged activity. Following is a <br />summary of observations made during the inspection: <br />New trails across the reclaimed area on BLM were found. One trail is across the repaired slide <br />area in TSN, R87W, sec. 17 NWSW. Another ATV trail across reclamation was found south of <br />the first trail, heading east into the drainage and is on the border of TSN, R87W sec. 17 NWSW <br />and sec. 17 SWSW. Further to the south another track was found along the fence bordering <br />BLM and Peabody property in TSN, R87W, sec. 17 SWSW and sec. 18 SESE. Pictures are <br />attached. The unauthorized disturbance appears to be from hunters. One hunter was <br />encountered during the inspection. He said they had permission from Jeffrey Fry, and adjacent <br />landowner to the west. The hunter was here only for the season from October 17- 25. He said he <br />and a friend were up hunting and they had an ATV; we found the ATV. There are many sets of <br />tracks and the tracks go over previously disturbed mining ground as well as previously <br />undisturbed ground. There is one existing 2 track road that existed prior to mining and is outside <br />the disturbance boundary; the access to it would be from across private (Peabody or Gary <br />Valora) in TSN, R87W, sec. 18 SESW. Dario Archuleta and Jennifer Maiolo will install signs <br />indicating closure of the appropriate trails and also signs that say "Stay on existing roads and <br />trails". Hopefully, with the closure of the trails across the reclaimed areas, the reclamation will <br />progress for permanent bond release. <br />Monitoring and maintenance continues on the Yoast mine. The mine permit boundary is 2,318.3 <br />acres. The permitted disturbed area contains 1,290.2 acres. Surface ownership is predominantly <br />private with limited areas of federal (240 acres) and state controlled surface. The mineral <br />ownership is also a mix of private, state and federal ownership. There are approximately 1,480 <br />acres of federal mineral estate within the permit boundary. <br />Photographs of current activities are attached.
