Notwithstanding the foregoing Restrictions, Declarant reserves for Declarant, its heirs, <br />successors, administrators, and assigns the following Reserved Rights and those <br />activities, without limitation, relating to agriculture, recreation, education, and as <br />appropriate for the development and maintenance of wetland and aquatic habitat and in <br />the development, exercise and maintenance of any and all water rights, now decreed or <br />otherwise and all associated ditches and structures used in connection with said water <br />rights. <br />(i) <br />Landscape Management. Declarant reserves the right to conduct such activities <br />on the Property as are necessary or convenient, and generally consistent with the <br />overall purpose of these Restrictive Covenants and with preserving the natural <br />condition of the Property. Such activities include, but are not limited to, <br />controlled burning and such reasonable steps as are necessary to control or <br />prevent (a) severe erosion or damage to the Property or portions thereof, and (b) <br />significant detriment to existing or permitted uses; access to, repair, and <br />maintenance of fences, ditches, ponds, and water control structures; and <br />installation and replacement of trees, shrubs, forbs, and grasses; and as <br />appropriate for the development and maintenance of wetland and aquatic habitat <br />and in the development, exercise and maintenance of any and all water rights, <br />now decreed or otherwise and all associated ditches and structures used in <br />connection with said water rights. Best management practices are specifically <br />allowed for the control of noxious species. <br />(ii) Wildlife Management. Declarant reserves the right to take all reasonable actions <br />designed to preserve, maintain and enhance wildlife habitats. <br />(iii) Recreation. Declarant reserves the right to approve and engage in passive <br />recreational activities, including but not limited to, hunting and fishing, with <br />cumulatively small impacts, which are not prohibited by these Restrictive <br />Covenants or by law, and are consistent with the continuing natural condition of <br />the Property. <br />(iii) Road Maintenance. Declarant reserves the right to maintain existing roads, trails <br />or walkways. Maintenance shall be limited to: removal or pruning of dead or <br />hazardous vegetation; application of permeable materials (e.g., sand, gravel, <br />crushed aggregate) necessary to correct or impede erosion; grading; replacement <br />of culverts, water control structures, or bridges; and, maintenance of roadside <br />ditches. <br />B. GENERAL PROVISIONS <br />1. Notification. Any notice, request for approval, or other communication required <br />under these Restrictive Covenants shall be delivered (a) in person, (b) by certified mail, <br />postage prepaid, return receipt requested, or (c) by facsimile, to the following addresses <br />(or such addresses as may be hereafter specified by notice pursuant to this paragraph): <br />WestWater Engineering APPENDIX B - 3 July 2012 <br />
