(i) General. Except as may occur by natural forces and except as appropriate for the <br />development and maintenance of wetland and aquatic habitat in accordance with the <br />agreed upon mitigation plan and in the exercise and maintenance of decreed and other <br />water rights and ditches, there shall be no filling, flooding, excavating; no removal of <br />natural materials; no dumping of materials; and, no alteration of the topography in any <br />manner. <br />(ii) Waters and Wetlands. In addition to the General restrictions above, there shall be <br />no draining, dredging, damming or impounding; no changing the grade or elevation, <br />impairing the flow or circulation of waters, reducing the reach of waters; and, no other <br />discharge or activity requiring a permit under applicable clean water or water pollution <br />control laws and regulations, as amended, except as may occur by natural forces and <br />except as appropriate for the development and maintenance of wetland and aquatic <br />habitat and in accordance with the agreed upon mitigation plan and in the development, <br />exercise and maintenance of any and all water rights, now decreed or otherwise and all <br />associated ditches and structures used in connection with said water rights as set forth in <br />Section 2. <br />(iii) Trees/Vegetation. There shall be no disturbance of any living vegetation, <br />including clearing, burning, cutting or destroying of trees or vegetation, except as may <br />occur by natural forces and except as (a) expressly authorized in the Reserved Rights, (b) <br />appropriate for the development and maintenance of wetland and aquatic habitat, and (c) <br />appropriate for annual maintenance of ditches and land and in the exercise of decreed and <br />other developed water rights; there shall be no planting or introduction of invasive or <br />noxious species of trees or vegetation. <br />(iv) Uses. No industrial or commercial activity shall be undertaken or allowed other <br />than those activities, without limitation, as permitted under Section 2, and as appropriate <br />for the development and maintenance of wetland and aquatic habitat and in the <br />development, exercise and maintenance of any and all water rights, now decreed or <br />otherwise and all associated ditches and structures used in connection with said water <br />rights, including, but not limited to, motorized vehicles which would result in the <br />degradation of the land or the wildlife habitat thereon and winter maintenance of access <br />road and pedestrian trails other than designated maintenance trails. No residential use or <br />development of the Property will be allowed. No grazing of domestic livestock will be <br />allowed. Uses for recreation and educational purposes will be allowed to the extent that <br />they do not significantly impair or interfere with the conservation values of the Property <br />as approved by the Declarant. <br />2. Rights Retained by Declarant ("Reserved Rights"). The Declarant retains all of <br />the customary rights of ownership including, but not limited to, it's present right to <br />access, to control access to, and to use the Property for all purposes not prohibited by <br />these Restrictive Covenants. <br />WestWater Engineering APPENDIX B - 2 July 2012 <br />
