COMMENTS
This was a complete inspection of the Foidel Creek Mine; C-1982-056 operated by Twentymile Coal, LLC. (TC).
I, Jared Ebert of the Colorado Division of Reclamation, Mining and Safety conducted the inspection. Mr. Jerry
Nettleton, with TC accompanied me during the inspection. The weather was partly cloudy during the inspection
both days.
AIR RESOURCE PROTECTION — Rule 4.17:
The mine site was observed and excessive dust was not observed. The haul roads and access roads were
maintained.
AVAILABILITY OF RECORDS — Rule 5.02.4(1):
The records were checked at the mine office. See the end of the report for details.
BACKFILL and GRADING — Rule 4.14
Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination 4.14.1(2)(f);
Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and Gullies 4.14.6:
No active backfilling or grading was observed with the exception of placing coal waste in the CRDA pile.

The Fish Creek Tipple pond was holding water and discharging. The embankment appeared stable and the
primary and emergency spillways were clear and functional. The diversion on the north and west side of the
reclaimed Fish Creek Tipple area was clear and functional. The repairs made to the embankment of the diversion
