Brock Bowls, DRMS <br />Page 2 <br />October 14, 2015 <br />For the NHN-003 ditch, the permittee must either re -design and move the ditch so that it is <br />not within the stream buffer zone with this revision or indicate how the construction, use <br />and reclamation of this ditch within the stream buffer zone will comply with the <br />performance standards outlined in Rule 4.05.18(l)(a)-(c). <br />Regarding the temporary crossing of Meehan draw. The permittee must provide details <br />about this crossing and how the crossing will comply with Rules 4.05.18(l)(a)-(c) or <br />remove this request for this crossing from this revision. If the permittee proposes to <br />construct a new road across the draw; the permittee will need to comply with the applicable <br />permit requirements for roads discussed in Rule 2.05.3 and the applicable performance <br />standards for roads discussed in Rule 4.03. <br />The Division is aware of two other areas where disturbance is proposed within the Meehan <br />Draw stream buffer zone that are not identified in the proposed revised section 4.05.18. The <br />currently approved east haul road and northwest haul road will cross Meehan Draw. The <br />design, construction, maintenance, reclamation and environmental protection measures <br />associated with haul roads are discussed in the currently approved section 2.05.3(3) of the <br />permit. The sediment control and site drainage plan in the current section 2.05.3(4) <br />contains information that could be applied to the protection of the stream buffer zones. The <br />information contained in these sections of the permit could be used the address the <br />performance standard required by Rule 4.05.18(l)(a)-(c) for the two haul roads. The <br />permittee will need to revise the proposed section 4.05.18 to include a discussion of the <br />construction of the perimeter haul roads within the Meehan Draw stream buffer zone and a <br />discuss how the construction, use and reclamation of these haul roads will comply with Rule <br />4.05.18(l)(a)-(c) <br />2.) The location of the stream buffer zones must be added to Map 2.05.3(4)-1; Surface Water <br />Hydrology. <br />a. Tristate response: The location of the stream buffer zones have been provided on Map <br />4.05-18-1. <br />b. DRMS response: This item is resolved. <br />3.) The operator should indicate in section 2.05.6(3) of the permit how the stream buffer zone will be <br />marked in accordance with Rule 4.02.5. <br />a. Tristate response: A description has been included in section 4.05.18 describing how <br />stream buffer zones will be marked in accordance with Rule 4.02.5. <br />b. Division response: This item is resolved. <br />
