Additional supporting
documents and updated Exhibits have been attached.
1. Proof of publication in a newspaper of general circulation on the locality of the
proposed mining operation has been enclosed as Attachment 1
2. Proof of notice to all owners of record of surface and mineral rights of the
affected land and owners of record of all land surface within 200 feet is
enclosed as Attachment 11.
3. Comments by History Colorado identify the Smith Homestead and Woolridge
Properties. It is our understanding that these historical resources are not
associated with the Brownwood Site. Regarding ACOE comments, the
project will not engage in any dredge or fill operations for jurisdictional sites.
Regarding DWR comments, the site will continue to be included in a valid
substitute water supply plan (SWSP) until such time as clay liners are
approved. The site does not intercept a significant volume of stormwater
runoff not accounted for in the SWSP to warrant release to the stream.
4. Land use zoning designations from Larimer County have been attached as
Attachment III. Residential is a use by right in the FA zone district.
PC Box 18087. BOULDER.
