adjustments has been completed for this 2015 Midterm Review. As of September 16, 2015, the <br />Division estimates reclamation liability at the Bowie No. 1 Mine is $2,199,283.16. This amount <br />is sufficient to assure completion of the remaining reclamation work at the site if the work had to <br />be performed by the Division, including the cost of re-establishing vegetation on any revegetated <br />areas, should those areas fail. The permittee currently has on deposit with the Division three <br />Corporate Sureties totaling $5,761,290.00. <br />When determining the amount to be released under a bond release request, the Division is <br />required to limit the release amounts to the percentages allowed under Rule 3.03.1(2), and ensure <br />that the release amount does not result in the Division holding less bond than would be required <br />to complete reclamation of the site in the event of a forfeiture (Rule 3.03.1(3)(d))_ A review of <br />the minimum bond retention amount, compared to the estimated costs to complete the remaining <br />reclamation tasks for which liability has not been released, indicates that the Division released <br />more bond liability under bond releases SL -2, SL -3, and SL -4. As such, the Division requires a <br />total minimum required bond of $3,439,562.61 to be retained under Rule 3.03.1. <br />SECTION IV — MIDTERM ADEQUACY QUESTIONS <br />Pursuant to 2.08.3, the Division finds that the permit application C-1981-038 contains eight <br />deficiencies following the review for the purpose of fulfilling the requirements of the Colorado <br />Surface Coal Mining Reclamation Act, and the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining. The Division requests that the permittee correct the <br />deficiencies by submission of revised permit pages under appropriate revision applications, or by <br />activities on the ground, by December 15, 2015. <br />Item 1: Rule 2.03.6, Volume I page 15, identifies Right of Entry and Operation Information. Per <br />Rule 2.03.6(1), each application shall contain a complete and detailed legal description of the <br />proposed permit boundary. Please revise the PAP to include the complete and detailed legal <br />description in order to compare Right of Entry documentation to the permit boundary. <br />Item 2: Per Rules 2.04.11(4) and 2.05.6(2), please update T&E species and discuss potential <br />impacts to current State and Federal Threatened and Endangered plant and animal species <br />lists. The Federal and State listed species of concern may have changed since the last <br />revision. To find the most up to date lists, please reference the USFWS and Colorado CPW <br />websites. <br />Item 3: Map 4-1, Hydrologic Reconnaissance, identifies drill holes associated with C-1981-038. <br />Based on information submitted under the Bowie No. 2 Mine (C-1996-083, PR -12, TR -104 and <br />SL -1) and Bowie No. 1 Mine, PR -4, several drill hole sites fall into the Bowie No. 2 Mine Permit <br />Boundary. In addition, there are several drill holes currently within the Bowie No. 1 Mine <br />identified on Map 4-1. In order for the Division to gain an accurate account of all the drill holes <br />currently permitted under C-1981-38, please provide an update in the form of a map or text <br />that identifies all drill holes permitted under C-1981-038 and the current status of each <br />Bowie No. 1 Mine -5- 10/13/2015 <br />
