SUCH COMPARISON SHOULD BE IN THE FORM OF <br />INFILTRATION, PERMEABILITY AND TEXTURE STUDIES. <br />Due to the Loadout not having yet been reclaimed, Stipulation No. 26 will remain active. <br />No new stipulations have been imposed since the issuance of Permit Renewal No. 6. <br />SECTION V — PERMIT VARIANCES AND SPECIFIC APPROVALS <br />The Bowie No. 1 Mine permit does not include a variance under Rules 2.06.2 (experimental <br />practices), 2.06.3 (mountaintop removal), and 2.06.7 (variance from contemporaneous <br />reclamation for combined surface and underground operations). The Bowie No. 1 Mine has <br />obtained a variance from the requirement for restoration of affected lands to their approximate <br />original contour (AOC) in accordance with Rules 2.06.5 and 4.27. The variance was granted <br />under the 1981 permit and was reaffirmed with RN -6. The variance applies to the mine benches <br />only and was granted due to a demonstration that backfilling the benches to AOC on the bench <br />slopes would not achieve the required slope stability factor of 1.3 (see permit Volumes 6 and 6A, <br />Stability Analysis, for complete discussion). <br />SECTION VI — BONDING SUMMARY <br />A compiled reclamation cost estimate was developed by the Division as a part of the Bond <br />Release No. 5 review process on February 9, 2015.
