September 22, 2015 C-1981-008/New Horizon Mine BFB <br />Pond 8 contained water but was not discharging (photo 2). <br />Pond 9 did not contain water. <br />Pond 13 contained water and was discharging. Some small rocks were placed in the rubber liner of the discharge <br />structure to hold the liner in place (photo 3). A few tamarisk saplings were noted in the east inlet that need to be <br />treated. <br />The culverts numbered 118 through 122 were clean. Culvert 123 needs cleaning. <br />Michael Morgan was repairing some gullies on the northwestern corner of his property by the former pond 11 <br />area. <br />ROADS — Rule 4.03 Construction 4.03.1(3)/4.03.2(3) Drainage 4.03.1(4)/4.03.2(4) Surfacing and <br />Maintenance4.03.1(5) and (6)/4.03.2(5) and (6) Reclamation 4.03.1(7)/4.03.2(7): <br />The SL -17 inspection started in the WFC conference room at 9:15. An overview was given about how the <br />bond amount was determined and the three phases of bond release. The SL -17 bond release application and map <br />was also presented and discussed. <br />The meeting then moved outside to 5"' Street where the former Northeast Haul Road was located. Dean Cooper <br />and Bobby Reeder, both from Montrose County, gave an overview of the 5"' Street and BB Road construction. <br />Both roads have a 60 foot right-of-way (fenceline to fenceline) and the road surface is 24 feet wide with a 4% <br />crown for water drainage. There were no questions or comments about the road construction. Several comments <br />were discussed during this inspection and are listed below. <br />Jim and Rosanne Guire presented a road maintenance map showing that cattleguards were installed in 5th Street <br />prior to mining. Presently, no cattleguards are in 5' Street. They would like WFC to install a cattleguard where <br />5' Street crosses their east and west property lines for a total of 2 cattleguards. <br />Jim and Rosanne Guire would like WFC to reinstall the straight -in access road from 5' Street to the Kanshack <br />property. The access road would be located just to the west of the current Pond 007. They presented historical <br />maps showing that the access road existed at one time. The current access road is not straight -in because it goes <br />around a topsoil stockpile. <br />Dean Cooper and Bobby Reeder (Montrose County) commented about Guire's request for cattleguards: Montrose <br />County worked with WFC and San Miguel Power (the landowner at the time of 5' St. reconstruction) and no <br />cattleguards were requested at that time. Montrose County has jurisdiction over the 5' Street and does not hold <br />WFC responsible for the installation of cattleguards. Montrose County will work with the Guire's if they want to <br />install cattleguards.
