This crossing requires a Nationwide Permit has been approved and which is enclosed below. <br />r DEPARTMENT OF TIIE ARMY <br />i; CORPS OF ENGINEERS, OXIAI IA DISTRICT <br />DFNV1 R RFC I'LATORI orPICE, 9307 SOUTH WADSWOR'I H BOULEVARD <br />LI I I LHON, COLORADO S01?8.6401 <br />= " June 12, 2015 <br />SUBJECT: Nationwide Permit Verification — Action No. NWO-2015-01055-DEN, Cold Placer <br />Road Crossing Middle Fork of the South Platte River <br />Todd Sullivan <br />JRS Mining LLC <br />850 N Davidson Street <br />Eloy, A7.85131 <br />Dear Mr. Sullivan: <br />Reference is made to the above-mentioned proposed project located at approximately latitude <br />39 2305138888889, longitude -106.017825, in Park County, Colorado. The work as described In <br />your submittal will consist of a new low water crossing for a gold placer mine that will go across <br />the Middle Fork of the South Platte River northwest of Fairplay, Colorado. 'rhe existing grade of <br />the river channel will not change, the rock will be placed in accordance with the existing grade, <br />except that the road surface will be Flat, resulting in a very slight drop to continue the grade <br />below the crossing. To do this, 0.009 acre of impacts will occur to the stream bed ofthe Middle <br />Fork of the South Platte River. <br />Based on the information provided, this office has determined that the work is authorized by <br />the Department of the Army Nationwide Permit (NWP) NWP 14 Linear Transportation <br />Projects., found in the February 21, 2012, Federal Register. Enclosed is a fact sheet, which fully <br />describes this Nationwide Permit and lists the General Conditions, and Colorado Regional <br />Conditions, which must be adhered to for this authorization to remail valid. <br />Although an Individual Department of the Army permit will not be required for this work, <br />this docs not eliminate the requirement that any other applicable federal, state, tribal or local <br />permits be obtained as required. Please be advised that deviations from the original plans and <br />specifications of this project could require additional authorization from this office. <br />The applicant is responsible Im all work accomplished in accordance with the terms and <br />conditions ofthe nationwide pcnuit. If a contractor or other authorized representative will be <br />accomplishing the work authorized by the nationwide permit on behalf of the applicant, it is <br />strongly recommended that they be prowidcd a copy of this letter and the enclosed conditions so <br />that they are aware or the limitations ofthe applicable nationwide permit. Any activity which <br />fails to comply with all the terns and conditions of the nationwide permit will be considered <br />unauthoriicd and subject to appropriate enforcement action. <br />Sullivan Aggregate Pit March 2015 D-4 <br />
