(TC). I, Jared Ebert of the Colorado Division of Reclamation, Mining and Safety <br />(Division) conducted the inspection. Mr. Brian Watterson with TC accompanied me on the inspection during the <br />afternoon on September 21st, 2015 and in the morning of September 22, 2015. Mr. Jerry Nettleton with TC <br />accompanied me during the afternoon on September 22nd. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />A records check was conducted at the mine office. Details of the Division's findings is at the end of this report. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />The 6MN reservoir is holding water and the embankment appears stable. The emergency spillway was clear and <br />functional. The Diversion ditch to the north and west of the reservoir was walked and appears clear and <br />functional. <br />The Fish Creek Tipple Pond, 6MN sediment pond, 18LT sediment pond, Pond B, Pond T, Pond D, Pond E, Pond <br />F and Pond G were observed. Ponds B, T, D and the Fish Creek Tipple Pond were discharging. The pond <br />embankments were stable, and the primary and emergency spillways appeared clear and functional if applicable. <br />RDA -6 drainage was stable and appears to be configured in accordance with the approved design. According to <br />Mr. Nettleton, this drainage will be continued and constructed along the 2nd bench of the refuse pile. <br />RDA -lb drainage was walked. This is an old drainage that has been stabilized with vegetation.
