Compliance With Mine Plan <br />N - Support Facilities Not On-site <br />N - Other <br />N - Special Categories Of Mining <br />N - Processing Waste <br />R - Topsoil <br />COMMENTS <br />This was a partial inspection of the Terror Creek Loadout conducted by Jim Stark of the Colorado Division of <br />Reclamation, Mining and Safety. The loadout is no longer operational and reclamation has commenced. The <br />weather was warm and sunny and the ground was dry. <br />HYDROLOGIC BALANCE - Rule 4.05: Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring <br />4.05.13; Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, <br />4.05.9; Stream Buffer Zones 4.05.18: <br />- The sediment pond was dry at the time of the inspection. The pond embankment was well vegetated and stable <br />and no erosional problems were noted. <br />- The roadside ditches were dry and clean at the time of the inspection. There were no erosional problems noted in <br />the ditches. <br />GENERAL MINE PLAN COMPLIANCE: <br />- The Terror Creek Loadout is no longer operational and the majority of the site has been reclaimed. The portable <br />crusher that was mobilized to the site last fall/winter has been removed. It is not anticipated that any further coal <br />processing or shipping will take place at the site. <br />ROADS — Rule 4.03: Construction 4.03.1(3)/4.032(3); Drainage 4.03.1(4)/4.032(4); Surfacing and Maintenance <br />4.03.1(5) and (6)/4.032(5) and (6) Reclamation 4.03.1(7)/4.032(7): <br />- The main haul road was stable and well maintained at the time of the inspection. The dirt/gravel portion of the <br />haul road and truck loop was also stable and well maintained. No problems were noted on either road segment. <br />RECLAMATION SUCCESS - Rule 4.15, Rule 3: <br />- The coal scale and the portable crusher have been removed from the site. The only structure, besides concrete <br />pads and walls, that remains at the lower bench is the scale house and the wheel mounted crusher that was moved <br />from Elk Creek.
