22. Please provide the Division with the approximate size (in acres) of the currently disturbed area within Tract 6
which is the area in reclamation of the adjacent CDOT mining permit M-1979-160. As explained above this
area is not fully releasable yet and will need to be accounted for in the reclamation cost estimate for this
conversion application; this acreage will be used for a general grading task to mitigate any future erosion and
a re -vegetation task to establish adequate vegetation.
The approximate size of the currently disturbed area within Tract 6 that lies within The CDOT mining
permit M-1979-160 is 3.9 acres.
23. In the conversion application, the Operator states that a NPDES permit to cover storm water runoff and
dewatering is not required. Please supply further information and data to justify that "all storm water will soak
into the ground before it can leave the site." In lieu of this data, commit to obtaining a Stormwater Discharge
Permit. The Operator shall contact the Water Quality Control Division (WQCD) of the Colorado Department
of Public Health and Environment for further information regarding this permit .Please supply the Division
with a copy of the submitted permit application or WQCD correspondence demonstrating that the proposed
plan will not require a permit.
The floor of the pit slopes into the working face. Experience over the last 29 years verifies that rainfall
pools on the mine surface, then evaporates. There is no runoff from the site.
24. Please note that any changes or additions to the application on file in our office must also be reflected in the
public review copy, which was placed with the Logan County Clerk and Recorder by the Operator. Please
submit proof that the public review copy has been updated or a copy of the response to this adequacy letter
has been added to it.
All additional information will be forwarded to the Logan County Clerk and Recorder for inclusion
with the public review copy.
25. Please submit the notarized agreements between the Operator and the persons having interests in the structures
provided in the Incompleteness Response letter received March 23, 2015, or submit other documentation in
accordance with Rule 6.4.19.
We are agreeing to mine no closer than 200 feet to the structures on property owned by Roman and
Tiffany Contet, Darrell and Shirley Smith, Gregory and Jill Yocumb, and Wayne and Debra Klee. No
structure agreements have been pursued.
To make the process more efficient, the Division has attached the new Performance warranty form which will
need to be filled out, notarized, and returned prior to permit issuance.
The newly provided Performance warranty has been completed and notarized. It is included as an
attachment.
