Beltramo and Sons, Inc., <br />DRMS File No. M-1998-101, Cesar Pit — Consent Agreement Due Diligence <br />Dear Mr. O'Donnell, <br />Please allow this to serve as a compliance report for the afore -referenced Division notice <br />of possible violations. <br />Corrective actions have been taken to address the possible violations promptly upon <br />receiving your notice and are summarized as follows for each inspection topic identified <br />in your inspection report dated April 24, 2015. <br />1. Inspection Topic: Off site damage and general compliance with mine plan <br />Possible Violation: Land has been affected outside of the approved permit <br />boundary. <br />Corrective Action: Tony J. Beltramo and Sons, Inc. have entered into a consent <br />agreement with the Division to amend the permit and institute measures to <br />maintain compliance. <br />2. Inspection Topic: Signs and Markers <br />Problem: The affected area boundary markers are missing or incorrectly placed. <br />This is a problem for failure to maintain boundary markers around the affected <br />area as required. <br />Corrective Action: Tony J. Beltramo and Sons, Inc. have caused surveying to be <br />commenced and the placement of temporary signs and markers to occur to clearly <br />delineate the boundary lines and angle points. We have 15 signs and markers in <br />place now with the wording "permit boundary," with black lettering on yellow <br />background for maximum visibility. Four on-site meetings have been held with <br />mining operators to ensure understanding and compliance. Further, Professional <br />surveying is taking place to permanently identify the boundary corners and set <br />visible and durable permanent signs and markers of the permit boundary as it is <br />being amended per our consent agreement. Please find attached photographic <br />proof of the progress of establishing signs and markers as required. <br />t' ;v <br />
