Proposed Decision <br /> <br />The Colorado Division of Reclamation, Mining and Safety proposes to APPROVE WITH <br />CONDITIONS for Permit Revision No. 7. PR7 expands the <br />permit area 795.72 acres to the east and reduces the permit area by 21.33 acres to the west. The <br />21.33-acre area encompassed reclamation parcel D-A-84 and was Phase III bond released with <br />the approval of the SL4 bond release application. With the approval of PR7, there will be a net <br />increase in 774.39 permit acres. No disturbance within the permit expansion area is proposed <br />with PR7 at this time. <br /> <br />To <br />proceed with a timely approval of Permit Renewal RN6, the Division and Trapper agreed that a <br />certain set of those adequacy issues would be addressed in the course of reviewing Permit <br />Renewal RN6, and the others would be addressed via a subsequent Permit Revision application. <br />The subsequent Permit Revision application became PR7, which was submitted to the Division <br />in May of 2013. <br /> <br />When RN6 achieved Final Approval in August of 2013, 89.50 acres of new topsoil stripping area <br />for calendar years 2015, 2016, and 2017 had been approved to occur within the existing permit <br />area (Map MAreas approved for coal <br />extraction within the existing permit area in calendar years 2013, 2014, 2015 and 2016 were <br />additional <br />The 89.50-acre area of new topsoil stripping disturbance within the existing permit <br />area was composed of three topsoil stripping areas: one for calendar year 2015 (24.79 acres), one <br />for calendar year 2016 (32.92 acres), and one for calendar year 2017 (31.79 acres). Because this <br />new 89.50-acre disturbance area was, however, not documented <br />Decision Form for RN6 as an increase in Disturbed Area, the Division is documenting the <br />approval of this disturbance in the Findings Document for PR7, and will make the necessary <br /> <br /> <br />Following the Final Approval of RN6 in August of 2013, the Division approved Technical <br />Revision TR113 in August of 2014, which approved 4.60 acres of topsoil stripping in the <br />calendar year 2013 area that had not been previously approved. The Division additionally <br />approved Minor Revision MR220 in October of 2014, which approved 2.30 acres of topsoil <br />stripping in the calendar year 2014 area that had not been previously approved. With the <br />approvals of TR113 and MR220, the total area approved for topsoil stripping within the existing <br />permit area of the Trapper Mine permit was increased from 89.50 acres to 96.40 acres. <br /> <br />When the application for PR7 was submitted to the Division, Trapper had indicated that it <br />intended to disturb 65 acres within the existing permit area, not 96.40 acres. Because the public <br />notice published by Trapper regarding PR7 indicated that PR7 would involve 65 acres of <br />disturbance, Trapper agreed to remove from the approved permit the 31.79-acre 2017 topsoil <br />stripping area that was approved under RN6, reducing the area approved for topsoil stripping <br />within the existing permit area under RN6, TR113 and MR220 from 96.40 acres to 64.61 acres <br />under PR7. During additional review of PR7, Trapper subsequently agreed to revise the number <br />of acres previously approved in RN6 for topsoil stripping in calendar year 2015 from 24.79 acres <br />to 25.00 acres, and to further revise the number of acres previously approved in RN6 for topsoil <br /> <br /> <br />4 <br /> <br />Trapper MineJuly 9, 2013 <br /> <br />
