Part B - Findings required by Rule 4 <br /> <br />The following findings and specific approvals are required by Rule 4. <br /> <br />I. Roads - Rule 4.03 <br /> <br />A. Haul Roads <br /> <br />Haul roads are discussed under Section 3.7.2, Vol. III of the permit application. <br /> <br />1. The Division has previously approved a temporary ford of an ephemeral or <br />intermittent stream having a watershed of at least one square mile during the <br />construction period, being that it will not alter normal water flow, contribute <br />sediment, or adversely affect fish or wildlife. All road construction occurs <br />upstream of adequate sediment control facilities. (4.03.l (2)(c)). <br /> <br />B. Access Roads <br /> <br />Access roads are discussed under Section 3.7.3, Vol. III of the permit application. <br /> <br /> <br />1.The Division previously approved fords of ephemeral streams in watersheds <br />of at least one square mile because they will not seriously alter normal water <br />flow, contribute to sediment load, or cause adverse affects to fish or wildlife. <br />The fords may occur when properly sized culverts are utilized. (4.03.2(2)(c)). <br /> <br />II. Support Facilities - Rule 4.04 <br /> <br />Support facilities are discussed under Section 3.8, Vol. III of the permit application. <br /> <br /> <br />A.Construction of support facilities will not result in damage, destruction, or <br />disruption of oil, gas, or water wells or pipelines, coal slurry pipelines, <br />railroads, or utility lines which pass over, under, or through the permit area. <br />Utility lines and a gas line pass through the permit area but are affected only <br />by the pit areas and not by any support facilities. Written approval from the <br />owner of the affected facilities has been submitted. The Division has <br />previously approved the activities (4.04(6)). <br /> <br />III. Hydrologic Balance - Rule 4.05 <br /> <br />Volume 4 of the Trapper Mine permit application includes an assessment of the <br />probable hydrologic consequences of the proposed mining operation. Each year, <br />Trapper assesses the ongoing impacts to the hydrologic system in its annual hydrologic <br />report submitted as Appendix W of the permit application. The probable hydrologic <br />consequences as set forth in Volume 4 and Appendix W are summarized below. <br /> <br />A.
