Fishes in the Yampa River Basin, in which a one-time fee of $3,173.18 be made payable to <br />the National Fish and Wildlife Foundation. Trapper promptly complied, paying the fee on <br />May 9, 2013. The USFWS also required Trapper to sign a recovery agreement of which <br />they signed on May 8, 2013. To complete the USFWS requirements, OSM wrote a letter, on <br />June 3, 2013 to the USFWS stating that OSM intends to retain discretionally Federal <br />authority for the Trapper Mining, Inc. in case re-initiation of the section 7 consultation is <br />required. On June 21, 2013 the USFWS issued their BO concurrence letter which concurred <br /> <br /> <br /> The Division found that the activities proposed by the RN6 applicant would not affect the <br />continued existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats. Endangered species of fish existing in the <br />Yampa River downstream of the proposed mining operation will not be adversely affected <br />based on the Section 7 consultation initiated by OSM and conducted by the Service. PR7 <br />does not substantially change the mining and reclamation operations approved in RN6. <br /> <br /> During RN6, Trapper made necessary updates to the threatened and endangered plant and <br />animal species portion of their permit (Sections 2.3.5 and 2.4.2). Only one change was <br />required for the Greater Sage-Grouse. This species was recently deemed by the USFWS a <br />candidate for threatened and endangered status. The Trapper Mine permit area does not <br />encompass core habitat for the Greater Sage-Grouse and is unlikely to impact this species. <br /> <br /> On June 13, 2013 the Division sent the OSM a letter requesting a section 7 consultation on <br />PR7. On July 1, 2013, the OSM sent a response letter indicating that a Section 7 <br />consultation was not needed for the PR7 at that time. The letter does indicate that if Trapper <br />intends on disturbing any of the 774.39 acres being added to the Trapper permit area via PR7 <br />that belong to the Federal Government, the Division would be required to initiate a Section 7 <br />consultation with the OSM. <br /> <br /> No impacts to any listed threatened or endangered species have been observed from past <br />mining activities at the Trapper Mine and none is projected. (2.07.6(2)(n)). <br /> <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br />this time, Trapper Mining, Inc. is current in the payment of reclamation fees required by 30 <br />CFR Chapter VII, subchapter R.
