Release on Reconstructed Portions of 13B County <br />Road and 51h Street <br />To Whom It May Concern: <br />Tri-State Generation and Transmission Association, Inc. (Tri-State), is the parent <br />company to Western Fuels -Colorado L.L.C., New Horizon Mine (New Horizon), Therefore, <br />Tri-State on behalf of the New Horizon Mine is notifying you that New Horizon is submitting an <br />application for Phase III performance bond release on BB County Road. This application for <br />Phase III release, when submitted, will be denoted as SL -17. A Phase III bond release is valid <br />for County Roads if the roads were designed and built to Montrose County specification, and <br />then accepted. Montrose County has accepted the roads. <br />This written notice is sent to you pursuant to Colorado Division of Reclamation, Mining <br />and Safety (CDRMS) Rule 3.03.2(1). Prior to filing a request for the bond release, New Horizon <br />must send written notices of intention to seek bond release.
