(Tri-State), is the parent company to <br />Western Fuels -Colorado L.L.C., New Horizon Mine (New Horizon). Therefore, Tri-State on behalf of <br />the New Horizon Mine is notifying you that New Horizon is submitting an application for Phase III <br />performance bond release on BB County Road. This application for Phase III release, when submitted, <br />wilt be denoted as SL -17. A Phase III bond release is valid for County Roads if the roads were designed <br />and built to Montrose County specification, and then accepted. Montrose County has accepted the roads. <br />This written notice is sent to you pursuant to Colorado Division of Reclamation, Mining and <br />Safety (CDRMS) Rule 3.03.2(1). Prior to filing a request for the bond release, New Horizon must send <br />written notices of intention to seek bond release.
