16. Revisions to the Mining Plan describe the earthen berm as being constructed with overburden not <br />topsoil. <br />17. The permanent manmade structures on the amendment area, which consist of a small abandoned <br />old house measuring 20' by 30' and an old unused loafing shed, are owned by the operator, Jim <br />Striggow. The new ownership of the property was consummated at closing on June 25, 2015 as <br />evidenced by a recorded Personal Representative's Deed copy included in the packet. The <br />buildings will eventually be torn down and the power and phone lines will be removed by the <br />appropriate companies who have ownership of the same. <br />18. A. The offsets of the eastern border of the amendment area in relation to the western edge of the <br />access road are 83' at the north tip and 170' at the south tip of the amendment area. The offsets <br />are depicted on the new Mining Plan Map. <br />B. The grade of the quarry wall which runs parallel to the access road furthest to the north is 1.9 to <br />1. The grade of the quarry wall which runs parallel to the access road on the south border of the <br />amendment area is 2.6 to 1. <br />C. The total depth of the quarry at the closest point to the access road including overburden and <br />Brownstone is 70'. <br />D. The material beneath the access road consists of a mixture of stone and clay. This material was <br />excavated from the adjacent east side of the access road to form the Poudre Valley Canal. <br />It is germane, to the scope of the issue, to mention that there are 2 French drain type structures <br />in the ditch bank that are in close proximity to the access road embankment in question. They <br />consist of buried gravel troughs that have a collection pipe embedded in the gravel. The <br />collection pipes feature a 10" exit pipe that allows the collected water to gravity flow away from <br />the ditch down the bank. These structures were designed to assist in the stability, of both the <br />access road and the ditch bank, by leaching water from beneath the access road and flow into <br />the Larimer County Canal downstream. During the times of year that water is in the Poudre <br />Valley Canal these 10"pipes connected to the French drain structures still flow freely with the <br />collected water even though they were constructed over 100 years ago. These structures are <br />noted on the new Mining Plan Map. The water flow from these two drain outlets, in co- <br />operation with the WRCC, will be re-routed so that the quarry amendment area does not <br />interfere with the drainage to the Larimer County Canal to the south. <br />Cross section maps of the amendment area are included in the packet. Map 1 shows the north <br />property line cross section indicating the dip of the Brownstone formation with the projected <br />depth of 15 '. Map 2 shows the cross section 200 ' south of the map 1 cross section. The access <br />road elevation and existing slope of the ditch bank are recorded and the intersection of the <br />Brownstone and projected slope extension are also plotted on these maps. <br />19. The proposed total of affected land including the amendment area is increased to 46.18 acres. <br />20. The additional haul road for the amendment area will generally follow the "old Driveway" to the <br />south as marked on the new Mining Plan Map.
