Wu I -kT � b"( L 0 �03 05�0, <br />(GI ryl <br />MINING LEASE <br />SAND -ROCK -GRAVEL <br />THIS LEASE, Made this day of 10th day of August 2015 <br />Between WINDY RIDGE LLC, 3963 COUNTY RD 5 5/10, LAMAR, CO 81052, LESSOR, and <br />JE CATTLE LLC, JUSTIN EMICK, 6424 HIGHWAY 287,LAMAR, CO 81052, LESSEE, <br />W I T N E S S E T H: <br />In consideration of the sum of One Dollar ($ 1.00) and other valuable <br />considerations, receipt of which is hereby acknowledged, Lessor hereby leases <br />to Lessee the tract of land shown below from the date of the lease until the <br />10' DAY OF AUGUST, 2017 for the purpose of quarrying, mining, removing and <br />marketing from there all sand, gravel, rock and other construction <br />materials. Said land is situated in the County of Prowers, in the State of <br />Colorado, and is described as: <br />NE 1/, OF SECTION 22 T27S R47W <br />SW % OF SECTION 22 T27S R47W <br />NE '/. PRICE: Lessee shall pay WINDY RIDGE LLC monthly on or before the <br />10th day following each month for gravel and overburden hauled from the premises <br />at the sum of .50 CENTS PER US TON Lessee shall maintain records of <br />truckloads hauled from the premises, which shall be furnished to Lessor, and <br />each truck hauling material will be designated on Lessee's records. Lessee will <br />cause test loads for each truck to be weighed at Lessor's request. However, it <br />is not the intention of the parties that each truckload be weighed. <br />2. ACCESS: Lessee shall have the right of ingress and egress to and <br />from the premises on roads presently located on said tract or upon roads <br />constructed by Lessee together with the right to erect temporary structures <br />such as screening and crushing plants, asphalt plants and other structures <br />necessary to remove and process gravel. <br />3. OPTION TO RENEW: Lessee shall have the right and option to renew with <br />permission of Lessor. <br />4. STOCKPILES: Lessee shall retain title to all sand and gravel mined and <br />stock piled on the premises, and Lessee shall have the privilege of stock <br />piling sand and gravel during the term of this option or any extension <br />thereof, whether in writing or not, until all pit reclamation has been <br />completed to the satisfaction of the Division of Minerals and Geology. Lessee <br />shall pay at the rate above set forth for stockpiled rock, crusher fines, and <br />sand as the same are removed. Stockpiles must be moved within one (1) year after <br />said lease is terminated, or paid for in advance with the lessors approval. <br />
