Compliance With Mine Plan N - Support Facilities Not On-site <br />N - Other N - Special Categories Of Mining <br />N - Processing Waste Y - Topsoil <br />COMMENTS <br />This was a partial coal inspection conducted by Jason Musick of the Colorado Division of Reclamation, Mining <br />and Safety on August 4, 5, and 6, 2015. The purpose of this inspection was to evaluate the on -the -ground <br />condition with respect to the Bowie No. 2 Mine's Phase I, II, and III bond release application, SL -01 in <br />accordance with Rule 3.03.2(2). Bill Bear of Bowie Resources; Christine Belka of the Office of surface Mining, <br />Reclamation, and Enforcement; and Jim Stover of J. E. Stover and Associates accompanied the inspection in its <br />entirety. Dan Gray of the US Forest Service accompanied the inspection on August 4th and Desty Dyer of the <br />Bureau of Land Management accompanied the inspection until 12:30 on August 5th. The weather was clear and <br />the ground was dry during the inspection. All areas to be inspected were accessible and visible. <br />Lands requested for liability release under SL -01 include 185 sealed drillhole sites and associated roads totaling <br />portions of 33.0 acres of Phase I and 49.4 acres of Phase II acres of land reclaimed through 2014. Surface land <br />ownership is private and Federal and mineral ownership is private and Federal. Throughout the inspection some <br />sites were removed from the SL -1 request based on various reasons. All sites visited are noted in the text and <br />tables below. Sites that were requested for bond release, but not visited are also noted. <br />Examples of sites and conditions are in the photographs below. <br />BACKFILL and GRADING — Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination 4.14.1(2)(f); <br />Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and Gullies 4.14.6: <br />Per Rule, up to sixty percent of the applicable bond amount shall be released when the permittee successfully <br />completes backfilling, regrading, and drainage control in accordance with the approved reclamation plan. With <br />regard to this SL -01 Phase I bond release, BRL applied for a partial Phase I bond release of 33.0 acres of disturbed <br />lands associated with the backfilled and graded area at portions of Gob Pile 42 and Gob Pile 91 totaling 7.4 acres. <br />Twenty-three drill sites and nine roads representing 17.1 acres were initially requested for Phase I with SL -01. 4.0 <br />acres of the Pitkin Mesa Pipeline disturbance is also requested for release. Also requested was 36.2 acres of drill <br />sites and 12.2 acres of roads for Phase I and Phase II and the Hubbard Creek Shaft and Freeman Gulch Shaft were <br />requested for Phase I, II, and III bond release. <br />Number of Partial Inspection this Fiscal Year: 2 <br />Number of Complete Inspections this Fiscal Year: 0 <br />Page 2 of 17 <br />
