Mr. Brock Bowles <br />August 10, 2015 <br />Page 7 <br />4.05.9 — Hydrologic Balance <br />1) It does not appear that the requirements of Rule 4.05.9(9) have been considered in the <br />designs for the three proposed sedimentation ponds. Please describe the measures that <br />WFC will employ to stabilize the upstream face of the sedimentation pond embankments. <br />Response: The text on Page 4 of Section 2.05.3(4) has been changed to include a <br />discussion of the measures that WFC will employ to stabilize the upstream face of the <br />sedimentation pond embankments. <br />4.05.18(1) — Stream Buffer Zones <br />1) It is unclear what specific disturbances will occur within stream buffer zones. In the <br />Stream Buffer Zones portion of section 2.05.6(3) of the permit, the operator must clarify <br />what specific disturbances will occur within these zones. <br />Response: A description of what specific disturbances will occur within stream buffer <br />zones has been provided in Section 4.05.18. <br />2) The location of the stream buffer zones need to be added to Map 2.05.3(4)-1; Surface <br />Water Hydrology. <br />Response: The location of the stream buffer zones has been provided on Map 4.05.18-1. <br />3) A description needs to be added in section 2.05.6(3) describing how the stream buffer <br />zone will be marked in accordance with Rule 4.02.5. <br />Response: A description has been included in Section 4.05.18 describing how the stream <br />buffer zone will be marked in accordance with Rule 4.02.5. <br />4) A discussion needs to be added to section 2.05.6(3) of the permit on how the disturbances <br />planned within the stream buffer zones will comply with the performance standards <br />outlined in Rule 4.05.18(1)(a)(b) and (c). <br />Response: A description has been included in Section 4.05.18 describing how the <br />disturbances planned within the stream buffer zones will comply with the performance <br />standards outlined in Rule 4.05.18. <br />5) A Corps of Engineers 404 permit needs to be obtained prior to disturbing stream <br />crossings and wetlands within the permit area which are located within the stream buffer <br />zones. WFC is proposing to disturbed areas within stream buffer zones and it is unclear <br />if a 404 permit has been obtained.
