Mr. Brock Bowles <br />August 10, 2015 <br />Page 2 <br />2.04.7(2) — Baseline Hydrology Description <br />1) The last sentence of Rule 2.04.7(2)(a) states that the permit application shall contain <br />information pertaining to ownership and use of surface water bodies. Map 2.04.3-1 <br />depicts the location of surface water bodies in and adjacent to the permit area. There is <br />also a discussion of stock water ponds, on page 21 of Section 2.04.7, that is limited to a <br />discussion of how they will be affected with the diversion of the 2nd Park Lateral, but no <br />description of the ownership of the stock ponds. It does not appear that the approved <br />permit application has provided sufficient information pertaining to ownership and use of <br />surface water bodies. Please either revise the permit application to include a description <br />of the ownership and use of surface water bodies, or indicate where the information is <br />located in the currently approved permit application package. <br />Response: The text in Section 2.04.7 has been changed to indicate that all surface water <br />bodies shown on Map 2.04.3-1 are owned by the surface landowners. Also, Map 2.04.3- <br />1 has been updated with surface landowner information. <br />2.04.9 — Soils Resource Information <br />1) In the opening paragraph, it states that Permit C-1981-008 was approved in May of <br />1993. The Division's records indicate that it was approved in 1983. Please correct this <br />typo in the text. <br />Response: The text has been changed to indicate that Permit C-1981-008 was approved <br />in 1983. <br />2) On page 27 second paragraph, it states that the Regional Supplement to the Corps of <br />Engineers Wetlands Delineation Manual. Arid West Region was issued in 2205. <br />Please clarify the date of issue for this supplement and correct the text. <br />Response: The text has been changed to indicate that the supplement was issued in 2005. <br />2.04.11 — Baseline Fish and Wildlife Information <br />1) Page 4 states that WFC commits to consult with the appropriate Federal and State <br />wildlife officials and modify the scope and focus of the fish and wildlife protection <br />measures and the wildlife mitigation monitoring requirements contained in Section <br />2.05.6. Per Rules 2.04.11(4) and 2.05.6(2), please update T&E species and discuss <br />potential impacts to current State and Federal Threatened and Endangered plant and <br />animal species lists.
