(Tri-State) has received your <br />midterm findings document for MT -01, dated December 19, 2014, and provides the following <br />responses to your midterm adequacy questions on behalf of the Western Fuels -Colorado, A <br />Limited Liability Company (WFC) New Horizon North Mine. <br />2.03.7(3) — Relationship to Areas Designated Unsuitable for Mining <br />1) On the western side of the permit boundary, a house is on the Garvey Bros Land & Cattle <br />Co. property (#7 on Map 2.03.4-1) that is within 300 feet horizontally of surface mining <br />activities. It is unclear if the house is an occupied dwelling which would require a <br />waiver from the occupant for mining to take place within 300 feet of the dwelling. Please <br />clarify in the permit text if the dwelling is occupied. <br />Response: The text in Section 2.03.7(3) has been changed to clarify that the dwelling <br />located on the Garvey Bros. Land & Cattle Co. property is unoccupied. <br />2.04.6 — Geology Description <br />1) Section 2.04.6, page I of the permit references Coal Mining Permit C-81-008 for <br />baseline surface and groundwater quality data. It is suggested that this information be <br />incorporated into permit C-2010-089, as permit C-1981-008 may be terminated prior to <br />permit C-2010-089 being terminated. <br />Response: WFC acknowledges the Division's suggestion to incorporate appropriate <br />baseline surface and groundwater quality data into permit C-2010-089 from permit C- <br />1981-008.
