This TR provides for post mining land use changes and <br />modification of the final reclamation plan. <br />When the Elk Creek Mine permit was first submitted and processed, there was no indication that <br />the coal mine methane would be viable for use in electrical generation or oxidation for carbon <br />offset credits. The success of the North Fork Energy, LLC (NFELLC) coal mine methane project <br />where 3 mw of electric power generation is sold to Holy Cross Energy and a thermal oxidizer is <br />employed to create offset credits, demonstrates the need to pro -actively prepare for such future <br />projects. In addition, Oxbow's affiliate company, Gunnison Energy Company (GEC) has moved <br />much of its employees and equipment onto Elk Creek Mine offices and property. Finally, there is <br />interest from residents of Somerset, and the North Fork Valley to re -use nearby mining surface <br />facilities for such uses as a fire station for the Ragged Mountain Fire District. <br />Thus, TR -76 addresses the proposal to change the post mining land use of the following five (5) <br />areas from the pre -disturbance rangeland land post mining use to an industrial/commercial land <br />use. <br />• The former Bear Creek fansite and powerline to provide for a coal mine methane <br />project. (2.3 acres). <br />• The upper Elk Creek facilities fan and utility bench, access roads and powerlines <br />to support the existing, and potential expansion of, the Elk Creek coal mine <br />methane project (North Fork Energy, LLC NFELLC) 2.9 acres. <br />• Former Sanborn Creek Portal area NFELLC coal mine methane project pipeline <br />(see TR -75) and East Elk Creek/Sanborn Creek road (old CDOT Highway 113). <br />0 Page 1 <br />
