Revised page 2.05-184.11 indicates a copy of the existing subsidence agreement with the <br />powerline operators has been forwarded to the Division. The agreements the Division has on file <br />in Exhibit 7-D 1 are from 1995 and 1996. Please provide updated letters from the owners of the <br />powerlines that might be impacted that state that the owners of the powerlines are aware of the <br />potential impacts and of the proposed mitigation/repair measures proposed for mining in the <br />WCR. <br />a. TC's response: The one powerline (Yampa Valley Electric) which will potentially be <br />affected by the activities proposed under PR10 is covered by an existing easement <br />agreement which allows for undermining and subsidence of the line. A copy of the <br />agreement is provided with these responses for insertion in Exhibit 2. <br />b. Division's response: Item resolved. <br />22. According to the table of contents for the Exhibit 7K, there are 15 total drawings included with <br />the evaluation. Exhibit 7K only included drawings 1 to 4. Please ensure all of the drawings, <br />tables and figures are included when the revised subsidence evaluation exhibit is submitted. <br />a. TC's response: The revised and updated subsidence evaluation and associated text <br />revisions provided as a supplemental submittal on March 19, 2015 address this Comment. <br />b. Division's response: Item resolved. <br />23. Revised page 2.05-181.11 indicates pasturelands overlie the WCR. Pasturelands fall under the <br />definition of renewable resource lands in accordance with Rule 1.04(110). Please revise this <br />section of the permit to include a description of the worst possible consequences that subsidence <br />will have on this renewable resource land in accordance with Rule 2.05.6(6)(b) and if necessary a <br />monitoring plan, subsidence survey and subsidence control plan. <br />a. TC's response: The referenced text discussion has been expanded to describe potential <br />subsidence -related impacts to those areas of pastureland which overlie the proposed Wolf <br />Creek mining area. As noted, subsidence effects will be negligible relative to the <br />pastureland use, so monitoring, surveys, and subsidence control plans are not applicable <br />or relevant. <br />b. Division's response: Item resolved. <br />24. Revised page 2.05-184.10 does not follow the text preceding it on the currently approved page <br />2.05-184.9. Revised page 2.05-184-.10 appears to begin with information regarding the Fish <br />Creek and Associated AVF on the previous section of the permit. This page also omits or deletes <br />a paragraph under a section titled Stock Ponds and Surface Water Monitoring Sites on the <br />currently approved page 2.05-184.9. Please review this proposed revised page and adjust it to <br />follow the text from the currently approved page 2.05-184.9. <br />a. TC's response: The referenced page and text section have been reviewed and revised to <br />address the noted concern with text continuity. Revised copies of the corresponding <br />pages accompany these responses for replacement in the PAP. <br />
