COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />July 27, 2015 <br />Jerry Nettleton <br />Twentymile Coal, LLC. <br />29515 Routt County Road 27 <br />Oak Creek, Colorado 80467 <br />RE: Foidel Creek Mine; C-1982-056 <br />2014 Annual Reclamation Report Review <br />Dear Mr. Nettleton: <br />The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed the 2014 Annual <br />Reclamation Report (ARR) for the Foidel Creek Mine for compliance with Rule 2.04.13. Below is a <br />discussion of the Division's review. Bolded items are issues that the Division requests Twentymile Coal, <br />LLC. (TC) respond to. <br />Rule 2.04.13 <br />(1) The report was received by the Division on January 30, 2015 prior to the February 15, 2015 <br />deadline. <br />a. The name and address of the permittee and permit number is listed on the cover letter of <br />the ARR. <br />b. The cover letter indicates that TC was granted approval to disturb an additional 49.2 <br />acres in 2014. However, Minor Revision No. 272 (MR272) was approved on January 17, <br />2014 and increased the approved disturbed area by 4.5 acres. This revision and acreage <br />was not accounted for in the 2014 ARR cover letter. Based on this, the total increase in <br />disturbed area approved in 2014 is 53.7 acres. Also, the liability increased by $43,882.00 <br />with the approval of this revision. <br />The 2014 ARR form submitted by TC indicates that 49.2 acres were permitted to be <br />disturbed in 2014 bringing the total disturbed area acreage to 711.6 acres. It appears that <br />TC modified this form to list the "permitted" acres to be disturbed. However, the intent <br />of this item on the form is to document the number of acres that were actually disturbed <br />within a calendar year and cumulatively over time. The 2014 Annual Reclamation <br />Report Disturbed Area table submitted with the ARR lists the areas disturbed at the site <br />and their respective acreage.
