Brannan Sand & Gravel Company <br />July 27, 2015 <br />Page 2 of 3 <br />3) The Division has reviewed the pre -mining groundwater data submitted with the original permit <br />dating back to 1980. The Division specially look at the groundwater elevation along the course of <br />the french drain from A to A'. The pre -mining groundwater elevation at A was approximately 5007 <br />feet while at A' the groundwater elevation was approximately 5005 feet (enclosed groundwater <br />contour map). This is an approximate 2 -foot elevation change over the course of where the proposed <br />french drain would be, from A to A'. The design proposes setting the french drain elevation at 5010 <br />at A feet and 5007 feet at A'. The proposed french drain design has a 3 -foot change between A and <br />A'. The Division believes that the gradient of the french drain should closely match the pre -mining <br />groundwater gradient. Please lower the design elevation of A by 1 foot, to 5009 feet. If the applicant <br />lowers the design elevation of A by 1 foot this will closely mimic the pre -mining groundwater <br />gradient and elevations. <br />EXHIBIT N - Source of Legal Right to Enter (Rule 6.4.14): <br />4) The western portion of the proposed french drain crosses property owned by Adams County. Please <br />demonstrate that the Applicant/Operator has legal right to enter the property owned by Adams <br />County to construct the french drain. <br />EXHIBIT L - Reclamation Costs (Rule 6.4.12): <br />5) Please see the enclosed cost estimate. The Division has accepted your cost to construct the french <br />drain and has accepted other cost provide by you in previous permitting actions. The Divisions has <br />also enclosed the cost estimate from AM -01. Please review the enclosed cost estimate, and provide <br />any comments you may have. <br />EXHIBIT S - Permanent Man -Made Structures (Rule 6.4.19): <br />6) Please demonstrate that the Applicant/Operator has attempted to obtain structure agreements with <br />any owner of a permanent man-made structure located within 200 feet of the affected area where the <br />french drain will be constructed. In accordance with Rule 6.4.19, when mining operations will <br />adversely affect the stability of any significant, valuable and permanent man-made structure located <br />within 200 feet of the affected area, the Applicant/Operator may either: <br />a. Provide a notarized agreement between the applicant and the person(s) having an interest in <br />the structure, that the applicant is to provide compensation for any damage to the structure; <br />or <br />b. Where such an agreement cannot be reached, the applicant shall provide an appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by <br />activities occurring at the mining operation; or <br />c. Where such structure is a utility, the Applicant may supply a notarized letter, on utility <br />letterhead, from the owner(s) of the utility that the mining and reclamation activities, as <br />proposed, will have "no negative effect" on their utility. <br />d. Please provide evidence (such as proof of delivery of certified letter to structure owners) that <br />a notarized agreement between the structure owners and the applicant was pursued. If an <br />
