The Amendment to AM -02 was called complete for review on June 22, 2015. Please be advised that
if you are unable to satisfactorily address any concerns identified in this review before the decision date,
it will be your responsibility to request an extension of the review period. If there are outstanding issues
that have not been adequately addressed prior to the end of the review period, and no extension has been
requested, the Division will deny AM -02. In order to allow the Division adequate time to review your
responses to any adequacy issues, please submit your adequacy responses to the Division no later than
one week prior to the decision date (September 21, 2015).
This review consisted of comparing the application with specific requirements of the Mineral Rules and
Regulations of the Colorado Mined Land Reclamation Board for the Extraction of Construction Materials
(Rules). In general, the application was adequate; however, as with most applications there are a few
items that will require the submittal of additional information or clarification of the existing information.
Inadequacies are identified under the respective exhibits, along with suggested actions to correct them.
APPLICATION FORM:
1) It appears that there is a discrepancy in the acreage portion of the application form (item # 3). Prior
to the approval of AM -03 the permit acreage was 176.24 acres. After AM -03 was approved the
permit area was increased to 177.34 acres. Based on the Division's a review of AM -02, it appears
that 0.327 acres of land will be added to the approved permit, bring the total permit acreage to 177.67.
Please re -submit the first page of the amendment application with the correct acreage.
EXHIBIT E - Reclamation Plan (Rule 6.4.5):
2) The seed mix in AM -02 is different than the seed mix described in AM -01. Both seed mixes are
enclosed. Please clarify which seed mix will be used in final reclamation.
of cow
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us
John W.
