United States Forest Clear Creek Ranger District 101 Hi hwa 103
U_ Au
SDA g g y
— Department of Service P.O. Box 3307
— Agriculture Idaho Springs, CO 80452
303-567-3000
FAX: 303-567-3021
File Code: 2810
Date: July 16, 2015
Michael A Cunningham
Colorado Divison of Reclamation, Mining and Safety JUS 1 2015
1313 Sherman Street, Suite 215
Denver, CO 80203 DIVISION OF REGATION
MINING ANIS S4EfY
Dear Mr. Cunningham:
This letter is in regards to the Notice of Intent (NOI) submitted by Stephen Hilgers, DRMS File
No. P-2015-016. The NOI has discrepancies in regards to the work occurring on private
property. A copy of the NOI was not submitted to our office. There are several impacts on
National Forest System lands (NFS) which require notification and approval.
The following are concerns we have with the NOI:
• A survey was completed in the fall of 2011, which revealed a shift in the actual location
of the Santiago Lode Claim and Santiago No. 1. Please see enclosed survey and map. It
appears that Santiago Levels #3, 4 and 5 are on National Forest System (NFS) land. A
map is requested that shows the location of these level areas and proposed work areas, in
relation to the re -survey. Any work on NFS will require analysis, authorization and a
bond.
• Road access to the site is not clear. A map showing the specific FS numbered access
routes is requested. The map included in the NOI is inadequate. A special use permit
proposal will need to be submitted on an SF299 Form to request snow plowing,
maintenance and/or widening of the road. Any roads closed to motorized use will also
have to be authorized. All required environmental analysis per NEPA and engineering
input will have to be completed before the special use permit can be issued..
• The USFS will be temporarily closing all public access to the Santiago Mill for hazardous
soil remediation to address the high levels of lead, arsenic and mercury in the parking
area, waste rock piles and the area surrounding the mill. Any access through the mill site
area will need to be permitted by the Forest Service.
If you have further questions, please contact Patti Turecek at 970-295-6656 or
pturecek@fs.fed.us.
s
Caring for the Land and Serving People Printed on Recycled Paper a
tea-'
