County shall pay at the rate set forth above thirty cents ($.30 per yard) for stockpiled material as <br />the same is removed from the premises. Stockpiles must be removed with one (1) year after <br />this Lease is terminated. <br />6. INDEMNITY: County accepts all responsibility for any and all liabilities in the mining, screening, <br />crushing and removal of material from the premises. County agrees to indemnify Owner against <br />all liabilities on all claims for damages and injuries of persons or property that are claimed to <br />have resulted from the activities or omissions of County or its agents or employees during the <br />terms of this Lease. County reserves all provisions of immunity as provided by Colorado law. <br />7. RECLAMATION: County reserves the right after termination of the Lease to enter the premises <br />for the purpose of reclamation of the property as ordered by the Division of Mineral and <br />Geology. <br />8. DEFAULT: If Owner claims that County has defaulted under the terms of the Lease Agreement <br />in any way, Owner shall first give written notice to County setting forth the alleged default and <br />what is required to cure this default. County shall then have sixty (60) days to dispute that a <br />default has occurred or to cure the default. <br />9. BINDING EFFECT: This Lease Agreement binds and inures to the benefit of the parties and their <br />respective heirs, personal representatives, successors and assigns.
