WKti <br />M 14 71 q ey <br />LEASE AGREEMENT <br />TTL <br />THIS LEASE AGREEMENT, made this Ae day of -d UIV ,between Robins <br />Redi Mix, LLC 1269 Colorado Street, Springfield, Colorado 81073, hereinafter referred to as "Owner", <br />and BACA COUNTY, COLORADO, 741 Main Street, Suite 1, Springfield, Colorado 81073, hereinafter <br />referred to as "County". <br />WITNESSETH: <br />In consideration of the promises contained herein and other good and valuable consideration, Owner <br />hereby leases to County the tract of land described below from June 1, 2015 to June 1, 2025, for the <br />purpose of quarrying, mining and removing therefrom all dirt, sand, gravel, rock and other construction <br />materials: <br />RECENED <br />TOWNSHIP 30 SOUTH, RANGE 48 WEST OF THE 6T" PM, Baca County, Colorado <br />Section 25: S2SE4SE4; S2N2SE4SE4; E2SE4SW4SE4; and SE4NE4SW4SE4 07 2015 <br />DRMS files #M-1977-484 ,UL <br />Gravel Pit No. 7 <br />Division of &eSa ety►on, <br />Mining <br />1. PRICE: County shall pay Owner monthly on or before the 21St day of the following month as <br />royalty for material hauled from the premises thirty cents ($.30) per yard or such higher amount <br />determined by the Board of County Commissioners to be paid to all gravel pit Lessors by the <br />County. <br />2. SALE OF MATERIAL BY OWNER: Owner may, subject to consent by County, negotiate to sell <br />material processed by County at the site, at any price acceptable to Owner. County shall be paid <br />$0.75 per yard for all material so sold. County will not unreasonably withhold consent to any <br />agreement to sell proposed by Owner. <br />3. ACCESS: County shall have the right to ingress and egress to and from the premises on roads <br />located on said tract, together with the right to erect temporary structures such screening and <br />crushing plants and other structures necessary to remove and process material. <br />4. OPTION TO RENEW: County shall have the option, to be exercised on or before the end of the <br />initial term, to renew this Lease for a successive period of ten (10) years upon the same terms <br />and conditions as set forth herein. Exercise of the option shall be in writing and mailed to the <br />Owner, postmarked on or before the date of expiration of the initial term. <br />5. STOCKPILES: County shall retain title to all material mined and stockpiled on the premises and <br />County shall have the privilege of stockpiling material during the term of the Lease and until all <br />pit reclamation has been completed to the satisfaction of the Division of Minerals and Geology. <br />
