and orderly fashion and disposed of as required by law. No trash or hazardous materials shall <br />be stored within the permitted area. The only hazardous material on site would be refined <br />petroleum products which shall adhere to the applicable Occupational Safety and Health <br />Administration (OSHA) and Environmental Protection Agency (EPA) regulations, including <br />tank construction, placarding, secondary containment provisions, approved tanks, and <br />operating equipment. No oil or lubricants shall be drained on the ground and no burning of <br />waste is allowed. No bore holes shall be used for disposal of waste materials. Human waste <br />shall be contained and shall be disposed of at an approved sanitary landfill. <br />25. Noise levels will be at or below the acceptable standards set by the Mine Safety and Health <br />Administration (MSHA) and the Occupational Safety and Health Administration (OSHA). <br />Crusher will be placed strategically along with stockpiles to minimize noise. <br />26. Upland Gravel will follow dust control procedures outlined in their operations plan and as <br />required under their State Health Dept. permit and their Mesa County Conditional Use Permit. <br />Dust shall be controlled by the use of water or an approved dust retardant, as directed by the <br />Grand Junction Field Office Manager. <br />27. The April 1, 2005 agreement between the Orchard Mesa Gun Club and Upland Gravel Inc <br />shall be fully adhered to. <br />28. The operator shall comply with all legal Federal, State, and County resolutions, <br />regulations, and permit requirements. <br />
