cumulative monthly total, remaining pre -paid royalty, and signature of the operator's <br />authorized representative. <br />Crusher Reports — In order to provide a cross check of weigh scale tonnages, the <br />operator shall include as part of the production report a crusher report providing <br />documentation of gravel and waste production (tons generated). The report shall" <br />include a breakdown of the gravel products generated for sale, including daily bucket <br />counts and tons per bucket, and also the amount of waste (fines) generated. <br />Weight Tickets - The weigh tickets completed by the driver, loader operator, scale <br />attendant, or other company official shall be available for BLM inspection. <br />Volumetric Surveys — In order to provide a cross check of weigh scale tonnages, the <br />operator shall periodically (as agreed to by BLM and Upland Gravels) conduct a <br />volumetric survey of mined -out portions of the pit and/or volume measurement for each <br />gravel product stockpile. <br />Fines — Any waste (fines) generated from crushing that are sold will have the same <br />royalty rate and production reporting requirements that apply to gravel products. <br />7. The existing bond for BLM ($57,785), which is the amount calculated by the Division of <br />Minerals and Geology (DMG) is applicable to this contract. The adequacy of the bond will be <br />periodically reviewed by DMG, and if necessary, the bond amount shall be adjusted to the <br />revised DMG cost estimate. The bond may be a bond of a corporate surety, certificate of <br />deposit, cash, irrevocable letter of credit, or negotiable Treasury bond, as specified under 43 <br />CFR 3602.14. The bond must be payable to Department of Interior — Bureau of Land <br />Management. <br />8. If the site becomes used on an intermittent basis such that additional sales contracts are not <br />made, the disturbed areas shall be reclaimed at BLM's discretion. <br />9. Reclamation will be an ongoing part of the operation, progressing at about the same rate as <br />the pit advancement. The unreclaimed pit disturbance at any given time shall be kept to the <br />minimum needed for mining, processing, and storage. Subsoil and topsoil shall be stripped <br />from mining blocks and placed directly into mined -out blocks as per the mining and <br />reclamation plan. The operator shall follow the reclamation plan and timetable as illustrated <br />and described in the reclamation plan. <br />10. If there is a problem with completing reclamation in accordance with the plan, no new <br />contract will be issued until the operator and BLM mutually agree on how the reclamation <br />issue will be resolved and progress has made toward resolving the problem. Additional special <br />stipulations may be required by BLM with each new contract. <br />11. Upon completion of this sales contract, it is anticipated that the haul road will be retained <br />for future access to remaining gravel reserves. Most of the haul road is located on BLM lands <br />and may not be removed (reclaimed) unless approved in advance by this office. <br />
