PERMIT #: M-2001-038 <br />INSPECTOR'S INITIALS: TOD <br />INSPECTION DATE: February 10, 2015 <br />OBSERVATIONS <br />This normal routine monitoring inspection was conducted by Tyler O'Donnell of the Division of Reclamation, <br />Mining and Safety (Division/DRMS). David Lincoln represented Bennett Sand and Gravel, Inc., the Operator, <br />during the inspection. <br />The Bennett Sand and Gravel Pit No. 2 is located in Adams County approximately 4 miles north/northeast of <br />Bennett, Colorado. The Bennett Sand and Gravel Pit No. 2 is a 47.75 -acre 112c Construction Materials <br />Reclamation Permit with a maximum allowed disturbance of 30 acres. The primary commodity beginning mined <br />at the site is sand and gravel. The permit was issued in August of 2001. The approved post -mining land use is <br />rangeland. The mine site was surrounded by the following land uses: residential, agricultural, and rangeland. <br />No problems or possible violations were observed during the inspection. During the inspection, the sky was clear <br />and the ground was dry. The site was not active during the inspection; however, it appears that the site sees <br />frequent mining activities. There were several pieces of mining equipment and two processing plants located <br />throughout the site. It appears that mining operation was progressing from north to south, from phase 5 all the <br />way to phase 4. It appears that the Operator has disturbed land in all 5 phases. Not all phases have been <br />completely affected by the mining operation, portions of each phase have been disturbed by the mining operation. <br />At the present time it appears that the mining operation has affected approximately 25 to 26 acres, throughout all <br />5 phases. There were portions of the site were partial grading has occurred. <br />Acid and Toxic Materials: <br />There was an on-site fuel storage tank in the northeast corner of phase 5 near the access road. The fuel tank <br />appeared to have adequate 110% spill containment. No evidence of a petroleum spill was observed during the <br />inspection. <br />(Note: Secondary containment structures shall consist of an impermeable containment which could contain all <br />contents of the tanks and various containers (when full) plus 10% of the total capacity.) <br />Backfilling and Grading: <br />The Operator has graded portion of the pit to 3H:1 V or flatter. There were several stockpiles of product scattered <br />throughout phases 2, 3, and around the processing plants. The northern portion of phase 4 and southern portion <br />of phase 3 contain approximately 1300 linear feet of an active highwall. The highwall had an average height of <br />approximately 20 feet. The highwall had an approximant slope of 1.5H:1 V to just flatter than 2H:1 V. When <br />completing finial reclamation, Operator will need to grade all slopes to 3H:1 V or flatter to comply with the <br />approved reclamation plan. <br />The Operator's representative discussed the possibility of importing general fill dirt generated off-site. Prior to <br />the importation of fill dirt generated off-site the Operator must notify DRMS. The Operator shall submit a notice <br />to DRMS in the form of a Technical Revision (TR). In the notice the Operator shall demonstrate compliance <br />with Rule 3.1.5(9). <br />Financial Warranty: <br />The current amount of financial warranty the Operator has on deposit with the State is $70,000. The reclamation <br />cost estimate for this site was updated during the file review for this inspection. It was determined that the current <br />required financial warranty amount is adequate. <br />Page 2 of 5 <br />
