result was a decrease in the liability. <br />A copy of the Division's estimate is included with this Midterm Review document. <br />SECTION III - REQUESTED REVISIONS OF PERMIT APPLICATION and <br />MIDTERM ADEQUACY QUESTIONS <br />As a result of this midterm review, for the purpose of fulfilling the requirements of the <br />Colorado Surface Coal Mining Reclamation Act, and the Regulations of the Colorado Mined <br />Land Reclamation Board for Coal Mining, pursuant to Rule 2.08.3, the Division finds that the <br />permit application C-1981-010 contains the below bulleted deficiencies. The Division requests <br />that the permittee correct the deficiencies by submission of revised permit pages under <br />appropriate revision applications, by September 30, 2015. <br />The Division recognizes that sections of the permit are currently being revised by PR -07. An <br />adequacy letter regarding PR -07 was sent to TMI on 6/12/2015. <br />2.03.4 Identification of Interest <br />• If PR -07 is not issued, TMI will need to update the applicable information in Section 1 <br />of the permit binder by August 28, 2015. <br />2.04.4 Baseline Cultural and Historical Information <br />2.04.4(2) <br />Appendix K of the permit contains the results of cultural resource inventories conducted for the <br />site. It should be noted that PR7 currently under review by the Division adds 774.8 acres to the <br />permit area to the east of the currently approved permit area. Trapper has not submitted a plan <br />to affect land within the expansion area. Prior to disturbance within this area, Trapper will <br />need to conduct a cultural resources survey. <br />• Pages 2-588 and 4-3 of the permit state that Archeological Site 5MF290 (A.K.A. <br />51VIF949) is within the proposed mine plan area but is outside of the permit area. This <br />site does not appear to be within the permit area or the mine plan area. These pages <br />will need to be updated accordingly. <br />• Page 2-588 indicates that site 5MF945 will not be destroyed by the mining operation; <br />however, page 4-3 indicates that site was disturbed by the mining operation during <br />the 1992-1997 permit term.
