These criteria adequately meet the requirements of Rules 4.05.3 and <br />4.05.4. <br />Rule: 2.05.4(2) (h) Reclamation Plans <br />The general requirements of this portion of the Reclamation Rule include: <br />A description of steps taken to comply with the Clean Air (42 U.S.C. Sec. 7401 et <br />seq.), and Clean Water (33 U.S.C. Sec. 1251 et seq.) acts and other applicable air <br />and water quality laws and regulations. <br />The Trapper permit provided the Construction/ Emissions permits approved in 2009 <br />by CDPHE Air Pollution Control Division (11MF253-1), and the Colorado Water <br />Quality Control Division CDPS permit (CO -0032115). <br />Permit sections 2.54 to 2.57D, 3.0, 4.7 and 4.8 adequately meet the requirements <br />of rule 2.05.4. (2)(h). <br />Rule: 2.05.6(1) Mitigation of Impacts <br />Permit section 2.0 (pgs 2-55 and 2-56) meets the requirements of Rule 2.05.6 (1) <br />by providing the air emissions permit from the Colorado Air Quality Control <br />Commission. <br />2.05.6 (3) (a)(i) (aii) (aiii) bi -v Mitigation of Impacts: Protection of Hvdrolooic Balance <br />Rule 2.05.6(3) was reviewed for protection of hydrological balance as it relates to <br />surface and alluvial water quality within permit area and adjacent areas and with <br />respect to Rule 4 (Performance Standards). The review included: <br />a. Description, maps and crossections (have ditch crossections) of measures to <br />be taken during and after mining, with respect to Rule 4, performance <br />standards. <br />b. Surface water quantity and quality (3ai) and (3aiii) <br />c. Water Rights (3aii) <br />d. Water treatment (3bii) <br />e. Hydrologic consequences of disturbance (3biii) <br />f. Monitoring Plan (3biv) <br />g. Hydrologic reclamation plan (3bv) <br />Maps were prepared to the standards of Rule 2.10. <br />Permit section 4.8.1.4 of Volume 4 pg 4-184 addresses all drainage from disturbed <br />areas. Permit section 2.7.7.3 of the permit discusses drainages in and adjacent to <br />the permit area and their potential as alluvial valley floors. Particular attention was <br />paid to Flume Gulch. The Hydrologic balance is addressed in Permit section 2.7.6 <br />Vol. II pages 2-525 to 2.576u. <br />Trapper Mid Term Review Prepared by: R.
