DRMS 02/18: The Division understands that GCC Energy, LLC is currently pursuing a Class <br />II Special Use Permit through La Plata County. Please revise Sections 2.03.10 of the permit <br />to include the identification number of the Class II Special Use Permit application in <br />accordance with Rule 2.03.10(3). <br />DRMS 06/14: Information about the county permit process was provided, as requested. <br />This item has been satisfactorily addressed. <br />a. (New) DRMS 06/14: The discussion on the Emission Permit does not mention that <br />Final Approval of Modification 1 to Permit No. 09LP0202F was issued on 9/3/2013. <br />Please revise the date of issuance, and expiration date, if appropriate. If the <br />expiration date (5/21/2015) did not change, please provide an explanation of the <br />current status of the mine's emissions permit. <br />2. DRMS 02/18: The Colorado Wastewater Discharge Permit System Certification listed in <br />2.03.10 and found in Appendix 2(3) expired on June 30, 2013. Please submit, for inclusion <br />in the permit, the letter issued to Coal operators by the Water Quality Control Division <br />documenting that an administrative extension has been granted. <br />DRMS 06/14: The administrative extension was submitted, as requested. This item has <br />been satisfactorily addressed. <br />2.04.7 Hydrology Description <br />1. DRMS 02/18: Water resources within one mile of the permit boundary [2.04.7(1)(a) and <br />2.04.7(4)] are described in King I Section 2.04.7 (pages 4-5) and King II Section 2.04.7 (page <br />3). Locations are depicted on Maps King 1-004 and King 11-004, although the maps do not <br />extend a full mile in all directions from the affected area. The information was last <br />updated for King I in August 1999 and for King II in August 2005. Please update and revise <br />as necessary the water resources text and associated maps in accordance with 2.04.7. <br />DRMS 06/14: Information on wells located within one mile of the permit boundary has <br />been updated, as requested, in Sections 2.04.7 and on Maps 004 of the permit. This item <br />has been satisfactorily addresse- <br />a. (New) DRMS 06/14: The King I and II permit text (Sections 2.04.7 Hydrology <br />Description) has not been expanded to incorporate a discussion of the updated well <br />information. As an example, the permit is silent on the wells from the Vista de Oro <br />subdivision. With respect to King I, there appear to be more wells in the vicinity <br />(downgradient) than there once were. Please update the 2.04.7 Groundwater <br />Hydrology discussion for King 1 and King 11, as appropriate. <br />2. DRMS 02/18: Rule 2.04.7(3) referring to alternative water supply information was <br />discussed in part in Section 2.05.6(3) of the permit. Water augmentation and water rights <br />document approved by District Court, Water Division 7 is provided in King II Appendix 2(5). <br />This application was approved April 20, 2011 and is to be filed every six years.
