1. DRMS 02/18: The Division understands that GCC Energy, LLC is currently pursuing a Class
II Special Use Permit through La Plata County. Please revise Sections 2.03.10 of the permit
to include the identification number of the Class II Special Use Permit application in
accordance with Rule 2.03.10(3).
DRMS 06/14: Information about the county permit process was provided, as requested.
This item has been satisfactorily addressed.
a. (New) DRMS 06/14: The discussion on the Emission Permit does not mention that
Final Approval of Modification 1 to Permit No. 09LP0202F was issued on 9/3/2013.
Please revise the date of issuance, and expiration date, if appropriate. If the
expiration date (5/21/2015) did not change, please provide an explanation of the
current status of the mine's emissions permit.
2. DRMS 02/18: The Colorado Wastewater Discharge Permit System Certification listed in
2.03.10 and found in Appendix 2(3) expired on June 30, 2013. Please submit, for inclusion
in the permit, the letter issued to Coal operators by the Water Quality Control Division
documenting that an administrative extension has been granted.
DRMS 06/14: The administrative extension was submitted, as requested. This item has
been satisfactorily addressed.
2.04.7 Hydrology Description
1. DRMS 02/18: Water resources within one mile of the permit boundary [2.04.7(1)(a) and
2.04.7(4)] are described in King I Section 2.04.7 (pages 4-5) and King II Section 2.04.7 (page
3). Locations are depicted on Maps King 1-004 and King 11-004, although the maps do not
extend a full mile in all directions from the affected area. The information was last
updated for King I in August 1999 and for King II in August 2005. Please update and revise
as necessary the water resources text and associated maps in accordance with 2.04.7.
DRMS 06/14: Information on wells located within one mile of the permit boundary has
been updated, as requested, in Sections 2.04.7 and on Maps 004 of the permit. This item
has been satisfactorily addresse-
a. (New) DRMS 06/14: The King I and II permit text (Sections 2.04.7 Hydrology
Description) has not been expanded to incorporate a discussion of the updated well
information. As an example, the permit is silent on the wells from the Vista de Oro
subdivision. With respect to King I, there appear to be more wells in the vicinity
(downgradient) than there once were. Please update the 2.04.7 Groundwater
Hydrology discussion for King 1 and King 11, as appropriate.
2. DRMS 02/18: Rule 2.04.7(3) referring to alternative water supply information was
discussed in part in Section 2.05.6(3) of the permit. Water augmentation and water rights
document approved by District Court, Water Division 7 is provided in King II Appendix 2(5).
