2.03.4 Identification of Interests
1. DRMS 02/18: Rules 2.03.4(6) (surface and coal ownership, etc. for the permit area) and
(7) (surface and subsurface ownership of areas contiguous to the permit) are not
addressed completely in King I and King II Sections 2.03.4 of the permit. Neither does the
text direct the reader to where the required information may be found. Please revise
permit sections 2.03.4 to include the required information, differentiating between those
owners within the permit area and those owners contiguous to the permit area. (The
Division suggests that, for ease of future updates, the addresses be shown in the permit
text only, and not on the maps.)
DRMS 06/14: New Sections 2.03.4(6) and (7) were added to the King I and King 11 text, as
requested. However, a check of the county GIS website revealed a number of apparent
discrepancies. Please review the names and addresses provided, and update as
necessary.
2. DRMS 02/18: King I and King II Maps 002 (Surface Ownership) provide the names and
addresses of the surface owners of land within and contiguous to the permit area (with
the exception of Wiltze [spelled "Wiltse" according to County records]). It appears these
maps have not been updated since 2007 and 2006, respectively. Please review the
information represented on these maps for accuracy, and update as necessary.
DRMS 06/14: The surface ownership maps were updated, but a partial check of the
county GIS website revealed some discrepancies, particularly along the southern margin of
the King I permit area. Please review the ownership records, and update the maps (and
text) as appropriate.
3. DRMS 02/18: King I and King II Maps 003 (Coal Ownership) were last updated in 2007 and
2006. Please review the information represented on these maps for accuracy, and update
as necessary. Also, while addresses for Huntington Ranches LLC., the State of Colorado
and Bureau of Land Management are provided on Maps 002, and these entities also
appear to own coal, the Division could not locate addresses for the Four Daughters Coal
Company and Tipotsch, Richard et. al., both of which appear to own coal within the King I
permit area that either has been mined or will be mined. Please update Maps 003 to give
names and addresses for all coal owners. (If preferred, as suggested above, this
information can be included solely in text Sections 2.03.4, as long as the maps include a
note directing the reader to the section.)
DRMS 06/14: The coal ownership has been updated, but information on Kambe and
Craig -Farmer -Compton was not provided in the 2.03.4(6) text. Please add these parties to
the list of coal owners.
4. DRMS 02/18: Rule 2.03.4(9) requires a statement of all lands, interests in lands, options,
or pending bids on interests held or made by the applicant for lands which are contiguous
to the area covered by the permit. Please provide information regarding any modification
that is being sought for existing Lease COC -63920. (Information required by this
